General Conditions of Agreement

The lease agreement, or contract, between the tenant and Sanssouci Barcelona shall be concluded when Sanssouci Barcelona has received the advance payment. The advance payment and the remainder to be paid upon at the day of arrival are stipulated in the agreement. If the advance payment fails to reach Sanssouci Barcelona by the agreed date, Sanssouci Barcelona shall be entitled to annul the rental agreement without warning and may lease the property to other parties without further notification, and without incurring any obligation to pay compensation.
Should the client, for whatever reason, cancel a reservation, the deposit will be refunded on the following terms:
2. Additional costs The additional costs (such as electricity, water, gas, etc.) are included in the rental price. 3. Security Deposit When the keys are handed over to the tenant a security deposit must be paid cash to Sanssouci Barcelona or his/her representative. Such amount will be refunded at the end of the holiday less any deduction made for damage caused to the property or for any additional costs that were not included in the rental price.
4. Arrival and Departure Until any further notice the arrival/departure dates and hours will be taken into account. Each major change to the arrival date and arrival time must be advised to Sanssouci Barcelona. In the case of unavoidable delay on the day of arrival, the tenant must contact as soon as possible Sanssouci Barcelona. In the event that Sanssouci Barcelona or his/her representative are not available and it is not possible to advise Sanssouci Barcelona or his/her representative of a late arrival, in the event that the late arrival was not previously advised of or in the event that Sanssouci Barcelona cannot accept a late arrival, the holiday-maker alone is responsible for the cost of the overnight stay in a hotel. Sanssouci Barcelona or his/her representative can fix a new meeting for the keys delivery, eventually the day after. The same applies in the case of early departures. In all these cases, Sanssouci Barcelona cannot be held responsible. No refund will be made if the guest is unable to occupy the apartment on the correct day or time due to travel difficulties, strikes or personal reasons. The same applies in the case of early departures. 5. Handover of the leased property, complaints The leased property shall be handed over to the tenant in clean and orderly condition. If any defects are present or if the inventory is incomplete when the property is handed over, the tenant must immediately submit a complaint to Sanssouci Barcelona, pointing this out. Otherwise, the leased property is considered to have been handed over in good condition. If the tenant is late in occupying the property, or if he fails to occupy the property at all, the full rental price shall remain due. 6. Careful use The tenant undertakes to use the leased property carefully, to obey the house or building regulations, and to show consideration for the other residents of the building and neighbours. The tenant is contractually obliged to keep the premises clean, and must surrender them in a clean and tidy state at the end of the rental period. In the event of any damage, etc., Sanssouci Barcelona must be informed immediately. The leased property must not be occupied by more than the number of persons stated in the agreement, which also includes children. Pets are not allowed. Sub-letting is not permitted. The tenant shall take care to ensure that his fellow occupants comply with the obligations set forth in this agreement. If the tenant or other occupants commit a flagrant violation of the obligations connected with careful use, or if more than the contractually agreed number of residents occupy the property, Sanssouci Barcelona can terminate the agreement without notice and without compensation. 7. Maintenance and failure Sanssouci Barcelona or his/her representative reserve the right to have free access to the property for essential maintenance purposes or in case of no good behaviours of the tenant and his/her householder. In case of failures, the tenant must advise Sanssouci Barcelona or his/her representative as soon as possible: according with the failure and the availability of technicians, Sanssouci Barcelona or his/her representative will provide to the repairing in a reasonable time. 8. Return of the leased property The leased property must be returned on the specified date, in an orderly condition, together with the inventory. The tenant shall be obliged to pay compensation for any damage and for any items missing from the inventory. 9. Liability Sanssouci Barcelona shall ensure that the reservation is correct and that the agreement is performed in conformity with the terms thereof. Sanssouci Barcelona has not taken out any insurance to cover the tenant's person or property during the rental period and therefore Sanssouci Barcelona cannot be hold liable for the damage caused to or the loss of goods or belongings that the tenants have or store inside the apartment during the term of lease. Liability shall be excluded for omissions on the part of the tenant or co-user, omissions by third parties which cannot be foreseen or averted, force majeure or events which Sanssouci Barcelona, intermediary or other persons called in by Sanssouci Barcelona could not foresee or avert, even though due care was taken. The tenant shall be liable for all damage that is caused by him or by the co-users; the fault shall be assumed. 10. Cancellation due to illness / insurance We recommend that tenants purchase holiday accommodation rental insurance, or at least cancellation insurance without an excess to cover unanticipated illness. 11. Force majeure, etc. If force majeure (environmental disasters, acts of God, natural disaster, fire in the booked apartment, officially imposed measures, etc.), or events which cannot be foreseen or averted prevent Sanssouci Barcelona reserves the right to cancel a part or all of the leasing arrangement, whereby claims for compensation are excluded. If it is impossible to provide all or part of the service, the paid amount or the relevant proportion thereof shall be refunded, to the exclusion of any further claims. 12. Alterations charges Alterations to the booking or if the holiday-maker intends to transfer his/her booking to other persons, on condition that the accommodation and the period do not change, must be required to Sanssouci Barcelona. Sanssouci Barcelona reserves the right to accept or not the request. 13. General Making the booking implies that Sanssouci Barcelona’s General Conditions have been understood and have thereby been accepted without reserve and without exception. Sanssouci Barcelona has no responsibility if the tenant claims ignorance of these conditions and terms. The holder of the leasing contract is held responsible of the lease. With the collection of he keys, the tenant declares that the house and all its furnishings are conforming and suitable for the purpose. He assures that the house will be left in good and clean condition and that he will pay for eventual damage caused by him or his/her householder/s. The tenant assures that he will contact Sanssouci Barcelona for any extra-ordinary damage of the house or other events above the rented premises. 14. Misprints Reservations are made for any pictorial or typographic errors. |
